The Supreme Court of Nepal has scrapped the writ petition demanding the cancellation of the 1947 Tripartite Treaty on the Gurkha Recruitment. On June 9, 2017, the former British Gurkha Association filed a petition in the apex court against the Gurkha Treatment Treaty. Padam Limbu, chairman of the British Gurkha Army Ex-Servicemen’s Organisation, had filed a writ petition in the Supreme Court demanding the cancellation of the 1947 agreement.
The petition was quashed but the apex court issued a mandamus in the name of the government to review the tripartite treaty between Nepal, the United Kingdom, and India on recruitment.
A tripartite treaty between Nepal, India, and the UK had been signed in 1947 to recruit Nepali youth in India, and British Gurkha regiments. The British Gurkha Army Ex-Servicemen’s Organisation demanded that the contract be cancelled, saying that it was unequal.
